Welcome to StayLit. By using our application, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using StayLit, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the application.

2. Description of Service

StayLit is a social application that allows you to check in daily and share your check-in status with mutual friends. Friends can send you nudges to remind you to check in, and you can optionally add trusted contacts who will be notified if you go silent for an extended period.

3. Account Registration

You must provide accurate information when creating your account. You are responsible for maintaining the security of your account and password. You must be at least 13 years old to use this service.

4. Acceptable Use

You agree not to:

Use the service to harass, bully, or stalk others
Create fake accounts or impersonate others
Use inappropriate or offensive display names
Attempt to circumvent rate limits or security measures
Use the service for any illegal purpose
Spam or send excessive nudges to other users

5. Content and Conduct

You are responsible for your display name and how you use the service. We reserve the right to remove content or suspend accounts that violate these terms without prior notice.

6. Not an Emergency Service

Important Notice

StayLit is NOT an emergency service, safety monitoring service, or medical alert system. If you believe someone is in immediate danger, contact emergency services (911 in the US) immediately. Do not rely on StayLit for emergency situations.

7. Trusted Contacts Feature

The trusted contacts feature allows you to designate people who will receive SMS alerts if you haven't checked in. Please understand the following limitations:

SMS alerts may be delayed or fail to deliver due to carrier issues
This is NOT an emergency response system
Recipients may not see messages immediately
StayLit is not liable for failed or delayed notifications
Always call 911 for emergencies

By adding trusted contacts, you confirm you have their consent to receive SMS messages from our service. Recipients can opt out at any time by replying STOP.

8. Termination

You may delete your account at any time through the app settings. We may terminate or suspend your account for violations of these terms. Upon termination, your data will be permanently deleted.

9. Disclaimer of Warranties

The service is provided “as is” without warranties of any kind, either express or implied. We do not guarantee the service will be uninterrupted, error-free, or meet your specific requirements.

10. Limitation of Liability

To the maximum extent permitted by law, StayLit and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to damages arising from:

Failure to receive or deliver notifications
Reliance on the service for safety or emergency purposes
Actions or inactions of other users
Service interruptions or data loss

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes through the app or by email. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
